Ownership and Agreement to Terms

Pool Furniture Direct is a wholly owned web store operated by Hart Digital Industries, Inc. All online orders placed with Pool Furniture Direct require acceptance of these Terms and Conditions to constitute a binding contract. For all other orders, a signed quote is required to create a binding agreement. The individual authorizing the order, either electronically or in writing, affirms responsibility for compliance with these Terms and Conditions.

Payment Methods and Terms

Pool Furniture Direct accepts Mastercard, Visa, American Express, Discover, corporate checks, and wire transfers. For payment arrangements, please contact us toll-free at 1-407-212-7747. If credit terms are granted, the payment term begins on the date merchandise ships. Pool Furniture Direct reserves the right to modify, revoke, or extend credit terms at its discretion.

Shipping and Delivery

Orders will be scheduled to ship as soon as possible unless otherwise requested in writing by the customer. While Pool Furniture Direct will make every effort to meet requested delivery dates, delivery times are not guaranteed. Requests to reschedule shipments must be submitted in writing at least seven (7) business days prior to the scheduled ship date. Additional charges resulting from customer-requested changes—such as storage, redirection of shipment, last-minute liftgate service, or other shipping-related costs not included in the original order—will be communicated in advance and billed to the purchaser.

Shipping Damage and Claims

All shipment-related damage must be documented on the delivery receipt at the time of delivery and reported to Pool Furniture Direct within three (3) business days of receipt. Title and risk of loss transfer to the purchaser once the merchandise is accepted by the carrier. It is strongly recommended to note on the delivery receipt: “Accepted subject to inspection for concealed damage.”

Product Warranties

All product warranties are provided and enforced by the original manufacturer. Written warranties are available upon request. Pool Furniture Direct does not extend, modify, or assume responsibility for any manufacturer’s warranty.

Liability

Pool Furniture Direct shall be held harmless against any claims, liabilities, or damages arising from the handling, installation, or use of the products sold.

Collections and Legal Venue

The customer agrees to pay reasonable collection fees and attorney’s fees as permitted by law in the event of nonpayment. All legal actions or proceedings arising from transactions with Pool Furniture Direct shall be brought exclusively in Volusia County, Florida.

Receiving, Installation, and Additional Services

The customer is solely responsible for receiving, unloading, assembling, and installing the merchandise unless otherwise specified in writing. Requests for additional services (e.g., liftgate service, inside delivery) made after the order is placed may incur additional fees and re-consignment charges. Refusal of delivery does not relieve the customer of delivery charges or associated costs.

Return Policy

Pool Furniture Direct offers a 30-day conditional money-back guarantee on stock merchandise. Items must be in new condition and returned in original packaging. Returns are subject to a 25% restocking fee and all associated shipping costs. A return authorization will be issued after the customer agrees to the return costs. Custom orders—including items with non-standard styles or customer-selected colors—are non-cancelable and non-returnable.

Price Changes

Pool Furniture Direct reserves the right to modify pricing and shipping costs at any time, including prices advertised on the website.
